Capacity and Forensic Evaluations

At Upward Behavioral Health, we specialize in providing comprehensive capacity and forensic evaluations tailored to meet the unique needs of our clients. Our services are designed for individuals who require in-depth psychological assessments, including competency evaluations and forensic evaluations, to support legal, medical, and personal decision-making processes.

Understanding Competency and Capacity

Competency Evaluations

Competency evaluations assess an individual's ability to understand and participate in legal proceedings. This evaluation focuses on whether the individual can comprehend the nature of the charges against them, assist in their defense, and make informed decisions regarding their legal options. Competency is a legal standard that varies depending on the jurisdiction and context, typically requiring the individual to have a rational and factual understanding of the proceedings. Competency evaluations benefit a wide range of individuals, including:

  • Defendants in Criminal Cases: Those who may not have the mental capacity to stand trial.
  • Individuals in Civil Litigation: Those who need to understand their legal rights and responsibilities.
  • Guardianship Cases: Individuals needing an assessment to determine their ability to manage personal or financial affairs.

Capacity Evaluations

Capacity evaluations determine an individual's ability to make informed decisions regarding personal, medical, or financial matters. Unlike competency, which is a legal determination, capacity is a clinical assessment that can vary depending on the specific decision at hand. It involves evaluating the individual's understanding of the relevant information, ability to reason, and ability to communicate their choices. Factors such as mental health conditions, cognitive impairments, and situational stressors can influence an individual's capacity. Evaluating capacity is essential in many contexts, such as:

  • Medical Decision-Making: Determining if a patient can consent to treatment.
  • Financial Decisions: Assessing if an individual can manage their finances or enter into contracts. We often evaluate clients whose capacity to manage their own finances or to make significant decisions regarding their finances has come under question.
  • End-of-Life Decisions: Evaluating if a person can articulate their wishes regarding advanced care directives.

Forensic Evaluations

Forensic evaluations encompass a broad range of psychological assessments conducted in legal contexts. These evaluations can include competency and capacity assessments, as well as evaluations related to criminal responsibility, risk assessment, and issues of mental health in legal settings. Forensic evaluations aim to provide objective, scientifically sound assessments that can inform legal decisions, support court proceedings, and assist in the understanding of an individual's psychological state in relation to legal matters.

Tenets of Evaluation

Comprehensive Medical Record Review

As part of our evaluation process, we conduct thorough medical record reviews. This includes examining previous psychological assessments, treatment histories, and any relevant medical documentation. These records provide vital context and insight into the individual's mental health history, enhancing the accuracy of our evaluations. As appropriate, comprehensive review may involve consultation with other professionals who have supported the client.

Diagnostic Interviews and Differential Diagnosis

Comprehensive diagnostic interviews are a cornerstone of our evaluation process. They allow us to gather detailed information about the individual's psychological and emotional state. We utilize differential diagnosis to distinguish between various mental health conditions, ensuring that our evaluations are accurate and meaningful.

Cognitive Evaluations and Personality Testing

We conduct cognitive evaluations to assess an individual's cognitive abilities, including memory, attention, and problem-solving skills. Additionally, as needed, personality testing helps us understand the individual's personality traits and how they may influence their behavior and decision-making.

Court Appearances

At Upward Behavioral Health, we understand that our evaluations may play a critical role in legal proceedings. Our clinical psychologists are available to provide expert testimony in court, ensuring that the findings of our evaluations are communicated effectively to legal professionals and judges. We are committed to supporting our clients through the legal process, offering our expertise to advocate for their needs.

Contracted and Third-Party Payor Services

At Upward Behavioral Health, we value collaboration with local school systems and case managers. We welcome referrals for capacity and forensic evaluations from these professionals, recognizing the important role they play in supporting individuals in need of psychological assessments.

To ensure a smooth evaluation process, we require that our third-party payor contract is signed before we proceed with any evaluations under these arrangements. This contract outlines the terms of service and payment responsibilities, ensuring transparency and clarity for all parties involved.

If you are a school system, case manager, or other referral source interested in partnering with us for evaluations, please reach out to discuss the process and how we can work together to best serve our clients.

Expedited Evaluation Services

Recognizing that many individuals require evaluations promptly, we offer expedited evaluation services. We understand that in urgent situations, timely assessments can significantly impact legal outcomes and personal well-being. To accommodate this need, we are willing to make arrangements for quick service and charge a rush rate of twice our typical hourly rate when necessary.

Availability and Mode of Evaluation
